Who qualifies for the FICA tip credit?

Restaurants, bars, nightclubs, cafes, and catering businesses qualify if their employees receive and report tips and the business runs payroll. If your staff report tips on their paychecks, you are very likely paying FICA tax on those tips, and that is exactly what the credit refunds. The eligibility check is free, and there is no fee unless a credit is secured. There are no upfront costs and no out-of-pocket money. You pay only if a credit is secured.

The qualifying checklist

If all four are true, the credit almost certainly applies to you. It can be claimed retroactively for up to 3 prior tax years, and for every year going forward.

Businesses that qualify

No new software or systems are needed. If staff report tips and you run payroll, you likely already have everything required.

Common questions

Do bars and nightclubs qualify? Yes. Bars and nightclubs with tipped bartenders, servers, and bottle service staff qualify the same way restaurants do, as long as the tips are reported and the business runs payroll.

Do catering businesses qualify? Yes. Catering venues and companies whose event staff receive and report tips qualify, provided those employees are on payroll.

How far back can I claim? Up to 3 prior tax years retroactively, plus the current year and every year going forward.

How do I find out for sure? Run the free eligibility check. It is a quick review of tipped payroll, there is no cost to check, and the work is success fee only.
